The Levine Act
Pursuant to California Government Code, Section 84308, Members of the Board who have received campaign
contributions totaling more than $250 may be required to disclose that fact on the record of the proceeding.
Parties and their paid agents may also be required to disclose on the record any campaign contributions made to a
Member of the Board that meets the following qualifications for disclosure. A Member of the Board of
Supervisors is disqualified and must recuse themselves on any agenda item involving business, professional,
trade, and land use licenses or permits and all other entitlements for use, if they received more than $250 in
campaign contributions from the applicant or contractor, an agent of the applicant or contractor, or any financially
interested participant within the 12 months prior to the final decision; and for 12 months following the date of the
final decision, a Member of the Board shall not accept, solicit, or direct a campaign contribution of $250 or more
from the applicant or contractor, an agent of the applicant or contractor, or any financially interested participant.

Meeting Procedures
The Board of Supervisors is the legislative body of the City and County of San Francisco. The Board has several
standing committees where legislation is the subject of hearings at which members of the public are urged to
testify. The full Board does not hold a second public hearing on measures which have been heard in committee.
Board procedures do not permit: 1) vocal or audible support or opposition to statements by Supervisors or by
other persons testifying; 2) ringing and use of cell phones or electronic devices; 3) bringing in or displaying signs
in the meeting room; or 4) standing in the meeting room. Each member of the public will be allotted the same
maximum number of minutes to speak as set by the President or Chair at the beginning of each item or public
comment, excluding City representatives; except that public speakers using interpretation assistance will be
allowed to testify for twice the amount of time. Members of the public who want to display a document should
place it on the overhead during their public comment and remove the document when they want the screen to
return to live coverage of the meeting.
IMPORTANT INFORMATION: The public is encouraged to testify at Board and Committee meetings. Persons
unable to attend the meeting may submit to the City, by the time the proceedings begin, written comments
regarding agenda items for the official public record. Written communications should be submitted to the Clerk of

Commission, Port Commission, or the Treasure Island Development Authority Board of Directors, may make a

entries and paths of travel into the building accessible to persons with disabilities or to

unreasonable hardship; to extend the period for granting extensions from those deadlines;
and to extend the time for the Department of Building Inspection’s Report to the Board of
Supervisors regarding the disability access improvement program.

and Retail Uses]

Ordinance amending the Planning Code to 1) allow Nighttime Entertainment Uses as
principally permitted on the ground floor and conditionally permitted on the second floor in
the Polk Street Neighborhood Commercial District (NCD); 2) modify requirements for
limited commercial uses within one-quarter mile of the North Beach Special Use District
(SUD); 3) conditionally permit Retail Professional Services Uses on the ground floor in the
North Beach NCD, subject to existing limitations; 4) allow limited commercial uses (LCUs)
in Residential, House (RH) and Residential, Mixed (RM) Districts with specified limitations;
5) require operating hours to end at 10 p.m. for LCUs and limited corner commercial uses
(LCCUs) in RH and RM Districts; 6) establish that LCCUs are limited to those uses
allowed in an NCD or SUD within one-quarter mile of the use, or the NC-1 District, as
specified; 7) prohibit outdoor activity areas not at the front of the building in RH and RM
Districts and limit such outdoor activity areas in other residential districts; 8) establish that
LCCUs in Residential Transit Oriented (RTO) Districts must be located on corner lots and
specify lot depth requirements; and 9) make minor corrections to code text; and affirming
the Planning Department’s determination under the California Environmental Quality Act,
making findings of consistency with the General Plan, and the eight priority policies of
Planning Code, Section 101.1, and making findings of public necessity, convenience, and
welfare pursuant to Planning Code, Section 302.

14. 231153 [Lease Amendment - DFS Group, L.P. - The International Terminal Duty Free
and Luxury Lease - Modify and Extend a Reduced Percentage Rent Structure
to December 31, 2026 - Establish a Temporarily Reduced Minimum Annual
Guarantee - $30,000,000]
Resolution approving Amendment No. 4 to the International Terminal Duty Free and Luxury
Store Lease No. 17-0303 between DFS Group, L.P. and the City and County of San
Francisco, acting by and through its Airport Commission, which continues the temporary
reduced Percentage Rent structure, but increases the percentage amount to 36% of gross
revenues, commencing with Lease Year 5 (2024) and continuing through Lease Year 7
(2026), and establishing a temporarily reduced Minimum Annual Guarantee of $30,000,000
for Lease Year 5, adjusting annually in accordance with the Lease through Lease Year 7,
with the original Base Rent structure recommencing in Lease Year 8 (2027), with each
such rent accommodation being conditioned upon Tenant’s timely completion of the
construction of its remaining facilities in Harvey Milk Terminal 1 no later than December
31, 2024, with no change to the 14-year term, to be effective upon approval of this

Resolution approving the Second Amendment to the Agreement between the San

(District) for long-term operation and maintenance of the Intertie Facility located in Milpitas
pursuant to Charter, Section 9.118, to re-designate the District as the Operation and
Maintenance (O&M) Party of the Intertie Facility from July 1, 2024, through June 30, 2029,
with the SFPUC and the District meeting and conferring before the end of the five-year
period to determine, by mutual written agreement, which of them shall be the O&M Party
beyond June 30, 2029. (Public Utilities Commission)

expend a $2,000,000 Grant from the Governor’s Office of Business and Economic
Development for the Union Square Park Revitalization for the period of January 1, 2024,
through December 31, 2026; to enter into a Grant Contract with the Governor’s Office of
Business and Economic Development; and to authorize the General Manager of the
Recreation and Park Department to enter into any modifications and amendments to the
Grant Contract that do not materially increase the obligations or liabilities of the City.
