230592 [Hearing - Appeal of Determination of Exemption From Environmental Review -
       Proposed 1151 Washington Street Project]
            Hearing of persons interested in or objecting to the determination of exemption from environmental
            review under the California Environmental Quality Act issued as a Categorical Exemption by the
            Planning Department on April 7, 2023, for the proposed project at 1151 Washington Street,
            Assessor’s Parcel Block No. 0213, Lot No. 025, to allow the demolition of a single-family dwelling
            and the construction of a four-story, 40-foot tall building containing 10 dwelling units (one
            three-bedroom unit and nine two-bedroom units), one unbundled off-street parking space and 10
            Class one bicycle parking spaces, within a RM-3 (Residential-Mixed, Moderate-Density) Zoning
            District and a 65-A Height and Bulk District; the seeking waivers from Development Standards
            including front setback (Section 132), rear yard (Section 134), dwelling unit exposure (Section 140),
            and bicycle parking (Section 155), pursuant to State Density Bonus Law. (District 3) (Appellant:
            Richard Drury of Lozeau Drury LLP, on behalf of Clayton Timbrell and the Upper Chinatown

            President Peskin opened the public hearing and inquired as to whether any individual wished to
            address the Board. Scott Emblidge, Richard Drury, and Hanmin Liu (Appellants) provided an overview
            of the appeal, responded to questions raised throughout the discussion, and further requested the
            Board to approve the appeal. Otto Duffy; Chen Wong; Raymond Ning; Speaker; spoke in support of
            the appeal and in opposition to the project. Lisa Gibson (Planning Department) provided an overview
            of the decision of the Planning Department and responded to questions raised throughout the
            discussion. Bill Chien (Department of Public Health) presented additional information and responded
            to questions raised throughout the discussion. Ryan Patterson and Brian O’Neill (Project Sponsor)
            provided an overview of the project, responded to questions raised throughout the discussion, and
            further requested the Board to uphold the decision of the Planning Department. Jane Natoli; Kent
            Raconi; Mike Chien; Adam Pavlacka; Hoya Badiva; John Gunaman; Alan Burradell; Robert
            Fruchtman; Brian Quan; Charles Ayers; Jonathan Randolph; spoke in support of the project and in
            opposition to the appeal. Scott Emblidge and Richard Drury (Appellants) provided a rebuttal and
            further requested the Board to approve the appeal. There were no other speakers. President Peskin
            closed public comment and declared the public hearing heard and filed.

            Due to the prior approval of File Nos. 230594 and 230595 during the previous Special Order
            (reversing the Planning Department's environmental review determination for this project), President
            Peskin reported that File Nos. 230630, 230631, 230632, and 230633 were no longer before the Board
            for consideration. Clerk Calvillo confirmed that the entirety of this Special Order regarding the
            Conditional Use authorization shall be Tabled by Operation of Law.

            2022-010833CUA, issued by the Planning Commission by Motion No. 21310, dated April 20, 2023,
