            The Board of Supervisors of the City and County of San Francisco met in regular session on
            Tuesday, October 16, 2018, with President Malia Cohen presiding.



ROLL CALL AND PLEDGE OF ALLEGIANCE
            President Cohen called the meeting to order at 2:03 p.m. On the call of the roll, Supervisors
            Fewer and Kim were noted not present. There was a quorum.

APPROVAL OF MEETING MINUTES
            President Cohen inquired whether any Board Member had any corrections to September 4, 2018,
            or September 11, 2018, Board Meeting Minutes. There were no corrections.
            Supervisor Ronen, seconded by Supervisor Peskin, moved to approve the September 4, 2018, and
            September 11, 2018, Board Meeting Minutes. The motion carried by the following vote, following

SPECIAL ORDER 2:00 P.M. - Mayor's Appearance Before The Board

180974 [Formal Policy Discussions - October 16, 2018]
            Pursuant to Charter, Sections 2.103 and 3.100(7), and Administrative Code, Section 2.11, the
            Mayor shall discuss the following eligible topic submitted from the Supervisor representing District
            3. The Mayor may address the Board initially for up to five minutes. Discussion shall not exceed
            two minutes per question or answer.

            1. Inclusionary Affordable Housing (District 3)
            Mayor London Breed addressed the Board of Supervisors regarding affordable housing and
            discussed the above referenced topic submitted by the District 3 Supervisor. Supervisor Peskin
            began the discussions by asking the following question: In June of 2016, 68% of San Francisco
            voters passed our “Inclusionary Housing for All” measure to maximize affordable housing in
            exchange for significant benefits to private developers. That led to you, me, and Supervisors Kim
            and Safai sitting down with a negotiating team made up of market-rate and non-profit developers
            and grinding out the most comprehensive affordable housing legislation in San Francisco history.
            Both sides made concessions and agreed on a couple of key tenets: 1) that we would assemble a
            Technical Advisory Committee to study the feasibility of various affordability requirements on a
            periodic basis; 2) that we would max the in-lieu fee in order to incentivize the more immediate
            construction of integrated affordable housing ON-SITE; and 3) that while the development
            community needed some certainty on the front end, the City also needed some certainty that
            developers would actually build their projects instead of sitting on valuable entitlements. Then you
            introduced legislation that, according to your press office, “keeps endangered housing projects
            moving forward,” but really all it does is give a pass to 33 large projects that were grandfathered
            into lower inclusionary requirements in exchange for the promise that they would actually build
            housing for our communities. All they had to do was get a site permit by December of this year
            (not even a first construction permit, which is what we originally wanted) and they got the financing
            certainty for their investors and a lower inclusionary requirement. Your legislation would cost the
            people of San Francisco hundreds of units of housing affordable to residents struggling to rent or
            own housing, constituting a 30% reduction in our BMR housing stock overall. After the exhaustive
            data-driven and stakeholder process that this City has gone through to secure the maximum
            number of affordable housing units, my question, is why are we setting a precedent that
            consensus policies can be changed to benefit market-rate developers to the detriment of our
            constituents, whose faith in our commitments is undermined when we don’t follow our own
            policies? Mayor Breed responded to Supervisor Peskin’s original question by indicating she
            strongly supports the Inclusionary Affordable Housing Program and the subject legislation is
            necessary to keep these 33 projects feasible and retain the 4,300 residential units and over 600
            affordable units. Mayor Breed further indicated she is open to reassessing the list of 33 projects,
            but does not want to see additional delays. Supervisor Peskin furthered the discussions by asking
            the following follow-up question: My office actually has come up against some of the same issues
            with getting departments to coordinate the processing of ADU applications in a timely and efficient
            way, or getting MOHCD to put together internal loan fund regulations so that we can release the
            quarter of a billion dollars of cheap and free money for the acquisition and rehabilitation of at risk
            affordable housing. So I agree and I’m with you there – I do want to say that given that this body,
            including you as our former Board President, had a unified position that fiscal feasibility was
            essential to our ability to strike the right balance of Inclusionary Housing requirements. Given that,
            I would like to ask you if you will commit to supporting requirements for each of these 33 projects
            that will get a pass from your legislation to go through a fiscal feasibility analysis. Mayor Breed
            responded to Supervisor Peskin’s follow-up question indicating her desire to start the process from
            entitlement and reiterated she is open to reassessing the list of 33 projects, but does not want to
            see additional delays or loss of housing. Mayor Breed did not ask any questions to the Members.
            Following public comment this matter was filed. No further action was taken.

            District Court, Case No. 3:17-CV-02928-JSC; entitled Suzanne Montes v. City and County of San
            Francisco, et al.; the lawsuit involves an employment dispute; other material terms of the
            settlement are restoring 384 hours of sick leave with pay and 240 hours of vacation to plaintiff.
