            Ordinance approving a Development Agreement between the City and County of San Francisco
            and Visitacion Development, LLC, for certain real property located in Visitacion Valley, bounded
            approximately to the north and west by McLaren Park and the Excelsior and Crocker Amazon
            Districts, to the east by the Caltrain tracks, and to the south by the San Francisco/San Mateo
            County line and the City of Brisbane; making findings under the California Environmental Quality
            Act, findings of conformity with the General Plan, and the eight priority policies of Planning Code,
            Section 101.1(b); and waiving certain provisions of Administrative Code, Chapter 56.

            Supervisor Cohen provided an overview of the project and further detailed changes to the
            accompanying agreement, namely, 1) revisions to Section 6.16 to clarify that the developer’s fire
            suppression contribution of up to $1,500,000 applies only to the development of a water system
            for major seismic events (in addition to this contribution, the developer will also be required to
            cover the full cost of a low pressure water system as required by Uniform Fire Code); 2) revisions
            to Section 6.16 to specify when the developer must make fire suppression contribution of up to
            $1,500,000 (this contribution will be due within 60 days after certificates of occupancy have been
            issued for all housing units in the first phase of development); 3) the addition of three sub-sections,
            1.4, 6.15, and 6.16, to the Table of Contents (the subsections themselves were already present in
            the previous version of the development agreement); and 4) changes to the spacing between
            certain sections and sub-sections.

            The President received a revised development agreement and the Board accepted the revised
            development agreement without objections.
            Supervisor Cohen, seconded by Supervisor Farrell, moved that this Ordinance be AMENDED, on Page
            4, beginning on Line 18, by deleting 'and the Mitigation Monitoring and Reporting Program, a copy of
            which is on file with the Board of Supervisors in File No. 140444'; on Page 7, beginning on Line 1, by
            deleting 'This Ordinance shall become effective on the date that all of the Project Ordinances are
            effective' and adding 'Effective and Operative Dates. This ordinance shall become effective 30 days
            after enactment. Enactment occurs when the Mayor signs the ordinance, the Mayor returns the
            ordinance unsigned or does not sign the ordinance within ten days of receiving it, or the Board of
            Supervisors overrides the Mayor’s veto of the ordinance. This ordinance shall become operative on
            its effective date or on the date that the last of the Project Ordinances becomes effective, whichever is

            Ordinance amending the Health Code to authorize the implementation of court-ordered Assisted
            Outpatient Treatment (AOT) for individuals with mental illness who meet the criteria established by
            California Welfare and Institutions Code, Sections 5345-5349.5 (“Laura’s Law”), to require the
            County Mental Health Officer create a Care Team to try to engage individuals referred for AOT in
            voluntary treatment prior to the imposition of court-ordered treatment; and making a finding that
            this authorization will not result in a reduction of current adult and juvenile mental health programs.
