(See infra.) Supervisor Becerril indicated she intends to move to table the Chinatown Area Plan resolution, File 000023, when the matter is called before the Board today. (See infra.). Privilege of the Floor Supervisor Leno, seconded by Supervisor Yaki, moved to suspend Rule 4.25 of the Rules of Order of the Board of Supervisors to grant privilege of the floor to the following guest. Ms. Cheng thanked the Board of Supervisors for the recognition. (Amends Section 106.3.2.3.2.) S. Court of Appeals for the Ninth Circuit, Lindsay v. Tacoma Pierce County, No. 98-35416, which concluded that the regulation of outdoor tobacco advertising by the Tacoma Pierce County Health Department Board of Health is preempted by the Federal Cigarette Labeling and Advertising Act. The City and County of San Francisco has local laws regulating certain tobacco advertising. This closed session would be permitted by Government Code Section 54956.9(b). (The City Attorney advises that, as of January 6, 2000, the City has not been threatened with litigation regarding this issue. Government Code Section 54956.9(b), and City Administrative Code (Sunshine Ordinance) Section No. 67.8 would not permit a closed session, unless the City receives such a threat by January 10, 2000.)
