The meeting was called to order at 2:00 p.m. On call of the roll, the following Supervisors were noted absent: Supervisors Katz, Yaki, Yee - 3. Quorum present. The motion carried by the following vote: Ayes: 8 - Ammiano, Becerril, Bierman, Brown, Kaufman, Leno, Newsom, Teng Absent: 3 - Katz, Yaki, Yee CONSENT AGENDA Recommendations of the Finance and Labor Committee 991266 [Amending Public Works Code relating to liens on delinquent water and sewer charges affecting individually metered tenant occupied single family homes and amending late payment and utility Ordinance amending Public Works Code Chapter X concerning the imposition of liens to recover revenues from delinquent water and sewer service accounts, by amending Section 150.1 to comport with organizational changes in the 1996 Charter, amending Section 150.2 to exempt the owners of tenant occupied single family dwellings from the imposition of water and sewer service liens; amending Section 150.3 for grammatical consistency; amending Section 150.4 to exempt the owners of tenant occupied single family dwellings from the imposition of water and sewer service liens, and deleting the phrase "special assessment"; amending Section 150.5 to exempt the owners of tenant occupied single family dwellings from the imposition of water and sewer service liens, for provision of written notice to other customers, and to permit the collection of administrative fees for overdue water and sewer service accounts; amending Section 150.6 to comport with organizational changes in the 1996 Charter; amending Section 150.7 regarding noticed hearings; amending Section 150.8 to eliminate the tax priority of liens filed under the existing ordinance; amending Section 150.9 to establish a late payment penalty fee for unpaid closed accounts; amending Section 150.10 to create a process for transfer of liens and other overdue accounts to the Tax Collector and Bureau of Delinquent Revenue Collection and authorizing the recovery of attorney’s fees and costs by the Bureau; amending Section 150.11 regarding release of liens upon payment and disposition of funds collected; and amending Section 150.12 increasing debt writeoff authority from $50 to $200 and authorizing the Bureau of Delinquent Revenue to compromise or abandon claims submitted to it by the Public Utilities Department. Ordinance No. 243-99 FINALLY PASSED 991392 [Authorizing agreements and acceptance of assets related to the dissolution of Western Addition Parking Corporation and the lease of the Japan Center Garages at 1660 Geary Boulevard and 1680 Ordinance authorizing the Department of Public Works to accept a gift of $550,000 from the City of San Francisco Western Addition Parking Corporation for the renovation of the Peace Plaza at the Japanese Cultural and Trade Center; approving the dissolution of the City of San Francisco Western Addition Parking Corporation and accepting the remaining assets and liabilities of said corporation; approving the transfer of said assets and liabilities to the Japan Center Garage Corporation; approving the form of lease of the Japantown Garage to the Japan Center Garage Corporation; ratifying previous actions taken in connection with the foregoing matters; and authorizing the taking of appropriate action in connection therewith. Resolution No. 828-99 ADOPTED The foregoing items were acted upon by the following vote: Ayes: 9 - Ammiano, Becerril, Bierman, Brown, Katz, Kaufman, Leno, Newsom, Teng Absent: 2 - Yaki, Yee REGULAR AGENDA NEW BUSINESS Recommendation of the Small Business, Economic Vitality and Consumer Services Committee 991107 [Earned Income Credit Forms] Supervisors Leno, Newsom Ordinance amending Administrative Code by adding Chapter 120, Sections 120.1 through 120.4, to provide that City contractors and subcontractors furnish to eligible employees certain federal forms necessary to claim the earned income credit. (Adds Chapter 120, Sections 120.1 through 120.4.) Supervisor Leno presented an amendment of the whole. Ordinance No. 245-99 Supervisor Leno, seconded by Supervisor Kaufman, moved that this Ordinance be AMENDED, AN AMENDMENT OF THE WHOLE BEARING SAME TITLE. The President requested a summary from the Department of Public Works. There being no representative present, it was decided to continue this matter to September 21, 1999. Requests to the Legislative Analyst shall require the affirmative vote of a majority of the members of the Board. 991677 [Legislative Analyst Request] Supervisors Newsom, Leno Motion asking the Legislative Analyst to research City and County fleet management, including performing an audit of the number of vehicles and the process by which those vehicles are shared and analyzing best practices from other cities; and to make recommendations to reduce the number of City vehicles on the streets of San Francisco. Resolution No. 827-99 ADOPTED 991657 [Anti-Latino Hate Flyers] Supervisors Ammiano, Becerril, Bierman, Teng, Leno, Newsom Resolution condemning the racist and anti-Latino misogynist and class-based hate motivated flyers distributed merchants and residents and urging the San Francisco Police Department, the District Attorney and the Human Rights Commission to fully investigate the matter. Supervisors Teng, Leno requested to be added as co-sponsors. Resolution No. 833-99 ADOPTED 991658 [Smoke Eaters Gazette] Supervisors Ammiano, Newsom, Bierman, Katz, Teng, Leno, Becerril Resolution condemning the racist and anti-Latino misogynist newsletter entitled "Smoke Eaters Gazette" that was published and distributed to members of the San Francisco firefighters and further urging the San Francisco Fire Department, the Hate Crimes Division of the San Francisco Police Department, the District Attorney and the Human Rights Commission to fully investigate the matter and to immediately terminate, penalize and prosecute the perpetrators as soon as they are apprehended. Resolution No. 834-99 ADOPTED 991659 [Fairness for Legal Immigrants Act of 1999, HR 1399, S 792] Supervisors Becerril, Bierman, Katz, Teng Resolution urging Congress to approve the Fairness to Legal Immigrants Act of 1999 (H.R. 1399, S.792), restoring federal benefits for legal immigrants who were in the United States before the welfare law passed and to the most vulnerable populations who arrived after the passage of the welfare law. Resolution No. 835-99 ADOPTED 991660 [School District Playing Fields] Supervisors Becerril, Bierman, Katz, Teng Resolution urging San Francisco Unified School District to make school district playing fields available to community members for soccer and other sports when they are not being used by schools and urging the San Francisco Department of Recreation and Park, together with community groups, to contribute to the maintenance of school district playing fields.
