CONSENT AGENDA Recommendation of the Finance and Labor Committee 991272 [Funding for the second round of Affordable Housing and Home Ownership Bonds (Prop. A) issued on June 10, 1999] Mayor Ordinance appropriating $20,000,895 of bond proceeds and bond interest income for implementation of the Affordable Housing and Home Ownership Program at the Mayor’s Office of Housing, for fiscal year 1999-2000. Ordinance No. 221-99 FINALLY PASSED Recommendations of the Housing and Social Policy Committee 991297 [Continuous grant for Police Department Domestic Violence Unit to continue a program which targets domestic violence repeat offenders] Resolution authorizing the Chief of Police of the City and County of San Francisco to accept and expend funds made available through the Office of Criminal Justice Planning for a project entitled "Violence Against Women - Law Enforcement Specialized Units Program", and agreeing to accept an in-kind match from Woman Organized to Make Abuse Non-existent (W.O.M.A.N. Inc.) for a victim’s advocate position, and waiving indirect costs due to funding constraints. (Police Department) Resolution No. 722-99 ADOPTED 991298 [Continuous grant for Police Department, Southern Station, to implement a Community Crime Resistance Program for the Sixth Street Corridor, provide "Citizens Patrol" program and improve Resolution authorizing the Chief of Police of the City and County of San Francisco to accept and expend funds made available through the Office of Criminal Justice Planning for a project designated "Community Crime Resistance Program" and agreeing to provide a cash match as required for this grant program, and waiving indirect costs due to funding constraints. (Clerk of the Board) Supervisor Kaufman moved to amend the title, line five, after "Buchanan Street" by inserting "and approving granting a conditional use permit subject to conditions imposed by Planning Commission and additional conditions imposed by the Board of Supervisors"; amend line 18, after "disapproved" by inserting "; and, be it FURTHER MOVED, That the Board of Supervisors approves granting a conditional use permit subject to conditions imposed by the Planning Commission by its Motion No. 14824, dated May 13, 1999 with the following two conditions being added by the Board of Supervisors: 1. No pharmacy shall occupy the ground floor retail spaces. 2. Ordinance No. 209-99 FINALLY PASSED by the following vote: Ayes: 11 - Ammiano, Becerril, Bierman, Brown, Katz, Kaufman, Leno, Newsom, Teng, Yaki, Yee Recommendation of the Public Utilities and Deregulation Committee 990455 [High-Speed Broadband Networks] Supervisors Katz, Yaki, Becerril, Bierman, Ammiano, Leno, Newsom, Brown, Teng Resolution urging the City Attorney and the Department of Telecommunications and Information Services to monitor legislative, regulatory and judicial developments in the California Legislature, Congress, the Federal Communications Commission and Federal Courts addressing access to high-speed cable and other high-speed broadband networks; to take all possible action to ensure that Congress, the Legislature and/or the Federal Communications Commission adopt policies that protect consumers’ access to a choice of Internet and other on-line service providers and to all forms of information over the Internet and over high-speed broadband networks; and to support the authority of cities to require cable companies to provide non-discriminatory access by unaffiliated Internet and other on-line providers to the broadband cable network by filing an amicus brief in support of the City of Portland’s open access requirement in the United States Court of Appeals for the Ninth Circuit. The motion carried by the following vote: Ayes: 11 - Ammiano, Becerril, Bierman, Brown, Katz, Kaufman, Leno, Newsom, Teng, Yaki, Yee Resolution establishing city policy supporting open non-discriminatory access to broadband access services and supporting non-discriminatory access by consumers to all content on the internet; urging the San Francisco City Attorney, the Department of Telecommunications and Information Services and the Telecommunications Commission to take all possible action to implement this policy at the federal, state, and local level by: 1) monitoring legislative, regulatory and judicial developments in the California Legislature, Congress, the Federal Communications Commission and Federal Courts addressing high-speed internet access; 2) monitor the market for broadband access services in order to gauge the necessity or feasibility of imposing an open access requirement; 3) requiring cable companies and other providers of high-speed internet access services to permit unrestricted access to all content on the internet in addition to allowing subscribers a singe "click through" directly to such content; 4) requiring cable companies and other providers of high-speed internet access services to provide universal access by consumers to any cable modem or high-speed internet access service in a service area in which cable modem or high-speed internet access service is offered; 5) filing an amicus brief in support of the City of Portland’s non-discriminatory access requirement in the United States Court of Appeals for the Ninth Circuit and; 6) urging the San Francisco City Attorney, the Department of Telecommunications and Information Services and the Telecommunications Commission to report back to the Board of Supervisors by December 15, 1999 on federal, state and local legislative, regulatory, judicial and technical developments and recommend a course of action for the City. Recommendations of the Public Utilities and Deregulation Committee 991386 [Community Aggregation of Electricity] Supervisors Ammiano, Bierman Resolution urging the California Legislature to amend the State’s electric deregulation law, Chapter 854 of 1996, Sections 366(A) and (B) to authorize San Francisco and any other California municipal corporation, upon a majority vote of its governing body or registered voters, to designate itself as the automatic aggregator of electricity on behalf of its residents and businesses, such that residents and businesses shall be automatically included in the jurisdiction’s community aggregated electricity buyers’ group, unless exercising a choice for the existing electrical corporation or another provider. For the purposes of this section, an order or judgment shall be considered final when a court of competent jurisdiction lets stand or affirms such order or judgment and any time for appeal or review of the order or judgment has passed. (b) Should AT&T or TCI or their wholly-owned subsidiaries enter into an agreement that requires nondiscriminatory access to its cable modem platform for providers of Internet access services, provided that any requirement by the City would be subject to equivalent terms and conditions. Notwithstanding the foregoing, nothing in this Franchise, nor the City’s failure to immediately require open, nondiscriminatory access as a condition of approval of the Resolution Approving Transfer of Control of the Grantee from TCI to AT&T adopted by the Board of Supervisors in File No. ____ shall prohibit or restrict the City’s authority to impose such a requirement on Grantee pursuant to any lawful authority and in accordance with any procedural requirements that may be applicable."
