The Levine Act
Pursuant to California Government Code, Section 84308, Members of the Board who have received campaign
contributions totaling more than $250 may be required to disclose that fact on the record of the proceeding.
Parties and their paid agents may also be required to disclose on the record any campaign contributions made to a
Member of the Board that meets the following qualifications for disclosure. A Member of the Board of
Supervisors is disqualified and must recuse themselves on any agenda item involving business, professional,
trade, and land use licenses or permits and all other entitlements for use, if they received more than $250 in
campaign contributions from the applicant or contractor, an agent of the applicant or contractor, or any financially
interested participant within the 12 months prior to the final decision; and for 12 months following the date of the
final decision, a Member of the Board shall not accept, solicit, or direct a campaign contribution of $250 or more
from the applicant or contractor, an agent of the applicant or contractor, or any financially interested participant.

Meeting Procedures
The Board of Supervisors is the legislative body of the City and County of San Francisco. The Board has several
standing committees where legislation is the subject of hearings at which members of the public are urged to
testify. The full Board does not hold a second public hearing on measures which have been heard in committee.
Board procedures do not permit: 1) vocal or audible support or opposition to statements by Supervisors or by
other persons testifying; 2) ringing and use of cell phones or electronic devices; 3) bringing in or displaying signs
in the meeting room; or 4) standing in the meeting room. Each member of the public will be allotted the same
maximum number of minutes to speak as set by the President or Chair at the beginning of each item or public
comment, excluding City representatives; except that public speakers using interpretation assistance will be
allowed to testify for twice the amount of time. Members of the public who want to display a document should
place it on the overhead during their public comment and remove the document when they want the screen to
return to live coverage of the meeting.
IMPORTANT INFORMATION: The public is encouraged to testify at Board and Committee meetings. Persons
unable to attend the meeting may submit to the City, by the time the proceedings begin, written comments
regarding agenda items for the official public record. Written communications should be submitted to the Clerk of

Commission, Port Commission, or the Treasure Island Development Authority Board of Directors, may make a
campaign contribution to a member of the Board of Supervisors, the Mayor, the City Attorney, or a candidate for

SPECIAL ORDER 2:00 P.M. - Mayor's Appearance Before The Board
Pursuant to Charter Section 3.100(7), the Mayor shall appear, in person, at one regularly scheduled
meeting of the Board of Supervisors each month to engage in formal policy discussions with members
of the Board. This item will be read at the Board Meeting on the second Tuesday of each month,
unless rescheduled by the Mayor and the Board President. The Mayor and the Board may not discuss
matters that have already been considered in Committee and that are on the Board's Agenda as an
action item.
By eight (8) votes, the Board of Supervisors may, by oral motion, allow an eligible District Supervisor
to ask a question that was not previously posed if the question relates to a sudden or unexpected
incident or occurrence raising formal, time-sensitive policy questions that were not anticipated prior
to the posting of this agenda. Public comment for this item will take place during general public
comment.

Ordinance authorizing the execution and delivery of Certificates of Participation on a
tax-exempt or taxable basis evidencing and representing an aggregate principal amount of
not to exceed $29,000,000 to fund all or a portion of the acquisition of the Concourse
Garage; authorizing the issuance of commercial paper notes in advance of the delivery of
the Certificates; approving the form of Trust Agreement between the City and County of
San Francisco and the Trustee (including certain indemnities contained therein);
authorizing the selection of the Trustee by the Director of Public Finance; approving
respective forms of a Property Lease and a Lease Agreement, each between the City and
County of San Francisco and the Trustee for the lease and lease back of certain property
and facilities of the City; approving the forms of Purchase Contract, Official Notice of Sale,
and Notice of Intention to Sell Certificates; directing the publication of the Notice of
Intention to Sell Certificates; approving the form of the Preliminary Official Statement and

Labor-Built and Union Pension Fund-Financed Housing]

Ordinance amending the Business and Tax Regulations Code to reduce the real property
transfer tax rates from 5.5% to 3% when the consideration or value of the interest or
property conveyed is at least $10,000,000 but less than $25,000,000; and from 6% to 3%
when the consideration or value of the interest or property conveyed equals or exceeds
$25,000,000 for transfers of certain properties with at least 12% rent-restricted affordable
units, that were constructed using union labor, and had a debt or equity investment of at
least $25,000,000 from a union pension fund at the time of the transfer; and affirming the
Planning Department’s determination under the California Environmental Quality Act.

and Easement Deed with San Mateo County Flood and Sea Level Rise Resiliency District
for the acquisition of a 1,386-square-foot easement for an aerial water pipeline crossing
and associated footings and braces across a portion of San Mateo County Assessor’s
Parcel Block No. 011-322-200 for $70,000 plus an administrative fee of $3,500 and up to

Resolution approving and authorizing the Director of Property, on behalf of the Human
Services Agency, Department of Disability and Aging Services, to execute a Lease
agreement with THE KELSEY CIVIC CENTER, LLC, for use of the ground floor commercial
space at 240 Van Ness Avenue as a Disability Community Cultural Center for the term of
15 years with three five-year options to extend and an annual base rent of $60,353 with 2%
annual increases beginning January 1, 2026, effective upon approval of this Resolution;
authorizing the City’s contribution of up to $1,167,500 towards the cost of tenant
improvements; and authorizing the Director of Property to execute any amendments,
options to extend the agreement term, make certain modifications and take certain actions
that do not materially increase the obligations or liabilities to the City, do not materially
decrease the benefits to the City and are necessary or advisable to effectuate the
purposes of the lease agreement or this Resolution.

Stormwater Improvement Project - Not to Exceed $17,800,000]
Resolution approving Amendment No. 2 to Contract No. PRO.0164, Engineering Services
for the Lower Alemany Area Stormwater Improvement Project, between the City, acting by
and through the San Francisco Public Utilities Commission (SFPUC), and McMillen
Jacobs Associates (dba Delve Underground), increasing the agreement by $8,300,000 for
a total not to exceed amount of $17,800,000 and extending the duration by three years, for
a total term of nine years from January 18, 2022, through January 17, 2031, due to
additional engineering needed to perform analyses, refine design as part of the Caltrans
encroachment permit, and to provide increased engineering support during construction,
pursuant to Charter, Section 9.118; and to authorize the SFPUC to enter into amendments
or modifications to Amendment No. 2 that do not materially increase the obligations or
liabilities to the City and are necessary to effectuate the purposes of Amendment No. 2.

9. 240762 [Settlement of Lawsuit - Build Group, Inc. - $350,000]
Ordinance authorizing settlement of the lawsuit filed by David M. Schmitt. against Build
Group, Inc., which then filed a cross-complaint against the City and County of San
Francisco, for $350,000; the lawsuit was filed on August 30, 2022, in San Francisco
Superior Court, Case No. CGC-22-601503, entitled David M. Schmitt v. Build Group, Inc. et
al.; the lawsuit involves allegations of breach of contract arising from cost overruns and
delay on the Zuckerberg San Francisco General Hospital Building 5 Rehabilitation
Department Relocation Project; other material terms of the settlement are a complete
release of claims relating to the project, including any pass through claims from David M.
Schmitt or other subcontractors of Build Group, Inc. (City Attorney)

12. PUBLIC COMMENT
An opportunity for members of the public to directly address the Board on items of interest to the public
that are within the subject matter jurisdiction of the Board, including items being considered today
which have not been considered by a Board committee and excluding items which have been
considered by a Board committee. Members of the public may address the Board for up to three
minutes. Each member of the public will be allotted the same number of minutes to speak, except that
public speakers using translation assistance will be allowed to testify for twice the amount of the public
testimony time limit. If simultaneous translation services are used, speakers will be governed by the
public testimony time limit applied to speakers not requesting translation assistance. The President or
the Board may limit the total testimony to 30 minutes.
Members of the public who want a document placed on the overhead for display should clearly state
such and subsequently remove the document when they want the screen to return to live coverage of
the meeting.
